What we are asking for:

Currently, Pennsylvania does not terminate the parental rights of a parent convicted of murdering the other parent of a child. Kimberlee’s law would terminate the rights of any parent convicted of first degree murder of the other parent of a child. Of course we are aware of the battered women’s sydrome defense, when a women murders her intimate partner in self defense. Through our research we have found that most women who kill an intimate partner in self defense do not receive a first degree murder conviction.

Amending Title 23 (Domestic Relations) of the Pennsylvania Consolidated Statutes, in proceedings prior to petition to adopt, further providing for grounds for involuntary termination.

(2) The parent has been convicted of one of the following in which the victim was the other parent of a child of the parent who has been convicted or either parent of any other child who resided in the household of the parent who

has been convicted:

(i) An offense under 18 Pa.C.S. Ch. 25 (relating to

criminal homicide).

(ii) An offense in another jurisdiction equivalent

to an offense in subparagraph (i).

(iii) An attempt, solicitation or conspiracy to

commit an offense in subparagraph (i).

(3) Any omission or series of repeated and continuing

omissions by the parent in the care of a child of the parent

or any other child who resided in the paren t ‘ s househol d

which results in a life-threatening condition or seriously

impairs the child’s functioning.

(4) A child of the parent or any other child who resided

in the paren t ‘ s household has been the victim of physica l

abuse resulting in serious bodily injury, sexual violence or

aggravated physical neglect by the parent.

THE GENERAL ASSEMBLY OF PENNSYLVANIA

AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the Pennsylvania Consolidated Statutes, providing for registration of domestic violence predators; establishing the Domestic Violence Predator Assessment Board; and imposing powers and duties on the Pennsylvania State Police and on the Pennsylvania Board of Probation and Parole.

It is the intention of the General Assembly that this act be known as Robin’s Law.

The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:

Section 1.  Title 42 of the Pennsylvania Consolidated Statutes is amended by adding a chapter to read:
